Now that the IEEPA tariff refund window is open, Capitol Counsel has acted decisively to secure a coordinated recovery solution for our clients.
U.S. Customs and Border Protection opened the CAPE platform last Monday, through which importers can now file to recover IEEPA tariffs invalidated by the U.S. Supreme Court’s February ruling.
The window to act is urgent: protest deadlines for early 2025 entries begin expiring in June, and entries are aging out of the most straightforward recovery path every day.
Through our new partners, who operate as a coordinated platform, our clients will have access to two complementary service lines:
- Meridian TradeAdvisors provides full-service IEEPA tariff filing, compliance, and recovery services. Meridian’s staff — including licensed customs brokers and processors with deep customs expertise — can calculate tariff payments to determine potential refunds, review and correct errors, file on the client’s behalf, coordinate and cover the cost of legal action to pursue refunds, and provide pre-funding through Meridian’s financing partner, Clear Cove Partners. There is no upfront cost; payment is required only if a recovery is achieved.
- Clear Cove Partners purchases all forms of government receivables, including IEEPA tariff refund claims, and provides advance funding so clients can receive the full amount of their validated IEEPA refund claim in two to three weeks, rather than waiting for the government reimbursement timeline. The ownership team has advanced funds to more than 3,000 clients in prior ventures, and can assist clients with any level of tariff exposure.
